I. APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
These general terms and conditions of sale (the "Terms") apply to all orders for products and services placed via the website www.siamoise.fr (the "Site") with the company Siamoise (the "Products") by any person (the "Customer").
The Customer must read the Terms and Conditions prior to placing any order (the "Order"), the Terms and Conditions being available on the Site.
Siamoise reserves the right to adapt or modify these Terms and Conditions at any time. The version of the Terms and Conditions applicable to any sale is the one displayed online on the Website at the time of the Order.
Consequently, validation of the Order by the Customer constitutes full and complete acceptance of these Terms and Conditions, accessible at any time on the Site.
II. SITE INFORMATION AND SITE ACCESSIBILITY
www.siamoise.fr is an e-commerce website that is owned and operated by the company Siamoise.
The Site is in principle accessible 24 hours a day and 7 days a week, except for scheduled or unscheduled interruptions for maintenance, security reasons or in cases of force majeure (as defined below). Siamoise cannot be held responsible for any damage resulting from the unavailability of the Site.
Siamoise The company does not guarantee that the Site will be free from anomalies, errors, or bugs, nor that the Site will operate without interruption. It may freely determine, at its sole discretion, any period of unavailability of the Site or its content. Siamoise cannot be held responsible for data transmission problems or network unavailability.
Siamoise reserves the right to modify the Site for technical or commercial reasons. When these modifications do not substantially and negatively alter the conditions of service provision, the Client may be informed of the modifications, but their acceptance is not required.
III. REGISTRATION ON THE SITE
To place an order, the customer can choose to create an account on the site or order as a guest, without obligation to open an account.
Registration is validated by Siamoise After verification of the form completed by the Client, the Client receives a confirmation email.
When creating their Account, the Customer agrees to provide accurate and complete information and to keep it up to date. In the event of an error in the recipient's contact details, Siamoise cannot be held responsible for the inability to deliver the Products.
By registering on the Site, the Client declares that they are of legal age and have the legal capacity to enter into a contract.
Siamoise may delete an Account at any time, for any reason, at its sole discretion.
IV. PRODUCTS
The Products offered for sale are those described on the Website on the day of consultation by the Customer, subject to availability. This information is updated in real time. However, an error in updating, regardless of its origin, does not constitute grounds for liability on the part of SiamoiseIn this respect, Siamoise cannot be held responsible for the cancellation of an Order due to stock depletion.
Siamoise We take great care in presenting and describing the Products to best inform the Customer. However, errors may occur, which the Customer acknowledges and accepts.
Siamoise does not guarantee the accuracy or security of information transmitted or obtained through the Site.
It is possible that the Customer may receive, following an Order, a part previously returned by another customer. Siamoise specifies that only undamaged and unworn Products are put back into stock after inspection.
V.ORDERS
Placing an order on the Site is subject to the procedure established by Siamoise, including successive steps up to the validation of the Order.
The Customer may select as many Products as they wish, which are added to their shopping cart (the "Cart"). The Cart summarizes the selected Products, their prices, and any applicable fees. The Customer may freely modify the Cart before confirming the order. Order confirmation constitutes acceptance of the Terms and Conditions, the selected Products, their prices, and any associated fees.
A confirmation email summarizing the order (products, price, availability, quantity, etc.) is sent to the customer. The customer expressly agrees to the use of email for order confirmation. Invoices are available in the "My Account" section of the website.
The customer may refuse to provide their email address; in this case, they agree not to receive order tracking updates and will only receive notifications necessary for the successful delivery of their package by our carrier, or for any other reason deemed to be in the best interest of Siamoise.
VI. REFUSAL TO PROCESS AN ORDER
Siamoise reserves the right to remove any Product from the Site at any time and to modify any content or information contained therein. Despite its best efforts, Siamoise may refuse to process an Order even after the confirmation email has been sent.
Siamoise cannot be held responsible for the damaging consequences of withdrawing a Product or refusing to process an Order after confirmation.
Siamoise may also refuse or cancel an Order from a Customer with whom it has a dispute over payment for a previous order or in case of objective suspicion of fraud.
VII. PRICE AND PAYMENT TERMS
Product prices are shown on the Site in euros for Europe, in pounds sterling for the United Kingdom and in US dollars for the United States, including VAT but excluding customs duties or other taxes, which are the responsibility of the Customer.
Products are invoiced based on the rates in effect at the time of registration and payment of the Order, subject to availability.
Payment for purchases is made in full at the time of ordering, via the secure Stripe payment platform.
Providing the Customer's bank details constitutes authorization to debit the total amount of the Order. In the event of non-payment, a cancellation notification will be sent to the Customer.
The data recorded by Siamoise or Stripe constitute proof of transactions between the Client and Siamoise.
Some promotional offers are subject to a minimum number of items. For example, the offer "-20% when you buy 3 items" is only applicable if at least 3 items are actually kept by the Customer.
In case of return, the promotion will be retained if and only if the order The discount is final after the return of 3 items. In the case of a partial return of the order which no longer meets the minimum requirements to qualify, the promotion will be cancelled, and the prices will remain the same. VIII. DELIVERY
Deliveries are handled by Chronopost and Colissimo from Monday to Friday.
Delivery means the transfer to the Customer of physical possession of the Products (the "Delivery").
The delivery charges applicable to the order are those mentioned on the website at the time of the order.
When Siamoise takes care of the shipping, the risk is transferred to the Customer at the time of Delivery.If the Customer chooses a carrier, the risk is transferred as soon as the Products are handed over to that carrier.
Delivery will be made to the address provided by the Customer, which must be their residential address, the address of a person of their choosing, or the address of a business. Delivery cannot be made to hotels or post office boxes. The accuracy of the information provided when placing orders remains the sole responsibility of the customer.
When delivery is advertised as "free," it means free delivery. If the customer, for whatever reason, cannot or does not wish to collect the package, they will be refunded minus the initial shipping costs (plus any non-collection/return fees charged by the carrier).
In the event of a failed delivery due to an incorrect address or failure to collect the package, no reshipment will be made without the Customer's express request and confirmation of their contact information. Reshipment costs will be charged based on the Customer's delivery location.
If the Customer refuses delivery or does not collect the package, and then requests a refund, this will be processed within twenty (20) business days from the date the package is returned or the Customer notifies the Customer of their refusal to have it reshipped, less any applicable fees (ranging from 10€ has 20 € (by attempted shipment based on the fees established by the carrier)
Siamoise Delivery is generally within five (5) business days in mainland France and within ten (10) business days internationally. These delivery times may be extended by ten (10) days following the launch of a collection, as well as during weekdays with public holidays, and during the month of May, which is a busy period with numerous public holidays.
This preparation time may also be extended for models marked "in controlled production" or "pre-order" for accessories, generally adding 7 to 20 business days. This timeframe is indicated on the relevant product page before placing the order.
In case of delay, the Customer may request cancellation of the sale and a refund of the sums paid.

IX. RIGHT OF WITHDRAWAL – REFUNDS AND RETURNS
9.1 Right of withdrawal
Due to our very short preparation time, we cannot guarantee the possibility of canceling an order before it is received. However, in accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the order to exercise their right of withdrawal, without having to justify their decision.
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for:
Jewelry, underwear, bodysuits and swimwear, for reasons of hygiene and health protection;
Any making or creation Siamoise any alteration for which you have requested (whether paid for or offered by our workshop) cannot be returned.
The right of withdrawal can be exercised by following the refund procedure;
9.2 Return Procedures
Upon receipt of the package, the Customer must choose one of the two proposed procedures:
1. Return Portal for Credits/Exchanges : Free return shipping.
2. Reimbursement Form : Flat-rate return shipping fee to be borne by the Customer per geographical area.
Once the procedure has been chosen, it cannot be changed.
The return must be made within fourteen (14) days of receiving the last item of the Order, in its original packaging, in perfect condition, unworn and unwashed.
9.3 Refunds
Refunds are made to the same payment method used for the Order, unless otherwise expressly agreed by the Customer, within fourteen (14) to twenty (20) working days after receipt of the return.
When a customer expressly chooses the "credit/exchange" procedure, including the free return label, she agrees to forgo a refund in favor of a credit or an exchange. This choice is informed and explicit and cannot be changed to a refund once the return has been validated and the free label has been used.
Refunds for orders paid for with a gift card or credit note will be issued exclusively in the form of a credit note.

Once the compliant product is received, the withdrawal period will begin, and the customer will then have 10 days to return it.
Using a credit note for a subsequent order will not change the purpose or extension of that credit note (which is valid for one year from the date of the initial order). It will not be possible to request a refund upon receipt of the completed order. The refund period cannot be extended if the credit note has expired at the time the returned package is received.
If the order was partially paid for with a credit note and a return request is made, then the refund will only be possible for the part paid in cash; the part paid by credit note will be reactive if the validity is still in effect.
9.4 Validity of the return
A return must be made within 14 calendar days from the date of receipt of the package.
The credit note can be used across our entire website for one year from the date of the initial order. This credit note can be used in conjunction with our current offers and promotions.
Returns for exchange are only valid once per order; therefore, an exchanged item cannot be returned for exchange, credit, or refund subsequently.
Using a credit note to place a new order does not extend its validity period and does not change the initial nature of the order file.
Therefore, a credit note initially issued cannot be refunded if the credit note is used for a subsequent order. The credit note will be returned to you with an updated refund amount, while retaining its original expiry date.
X. WARRANTIES – LIMITATION OF LIABILITY
10.1 Limitation of Liability
The responsibility of Siamoise is strictly limited to the purchase price of the Product. It cannot be held liable for indirect losses, such as loss of revenue, profits, contracts, data, moral damages or loss of opportunity.
Siamoise does not guarantee the absence of computer viruses on the Site and recommends that the Client protect their computer equipment.
10.2 Legal Guarantees
All Products benefit from the legal guarantee of conformity (articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
Legal guarantee of conformity: Two (2) years from the date of delivery of the Product; choice between repair or replacement, except at disproportionate cost;
Warranty against hidden defects: Action within two (2) years from the discovery of the defect; Full or partial refund depending on the Client's choice.

10.3 Force majeure
In the event of force majeure, Siamoise The Client shall be informed within fifteen (15) days. The obligations of the parties shall be suspended for the duration of the event. If the force majeure event lasts for more than three (3) months, either party may terminate the transaction without compensation.
XI. RETENTION OF TITLE
Siamoise retains ownership of the Products sold until full payment of the price. In the event of default of payment, Siamoise will be able to reclaim the Products sold, without legal formalities.
XII. PARTIAL DISABILITY
If any clause of these Terms and Conditions is declared invalid, the other stipulations shall remain in force.
XIII. NON-WAIVER
No tolerance or inertia of Siamoise cannot be construed as a waiver of his rights.
XIV. MEDIATION – APPLICABLE LAW – JURISDICTION
Sales are subject to French law.
The Customer may refer the matter to the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/.
In the absence of an amicable agreement, any dispute falls under the jurisdiction of the competent French courts.
